Who Can Represent You Before the IRS
Federal rules recognize three credentials with unlimited rights to represent taxpayers before the IRS. They are not interchangeable, and it is worth knowing the difference.
- Attorney
Licensed by a state court or bar, an attorney has earned a law degree and passed a bar exam, and holds unlimited rights to represent taxpayers before the IRS. An attorney is the right choice when a matter is truly a legal dispute or is heading toward litigation.
This is a legal credential. Top Pro Accounting does not provide legal or attorney services; our representation is provided by an Enrolled Agent, and we will tell you plainly if your situation calls for an attorney instead.
- Certified Public Accountant (CPA)
Licensed by a state board of accountancy, a CPA is an accounting credential that also carries unlimited rights to represent taxpayers before the IRS. Many CPAs concentrate on audit and assurance work rather than tax controversy.
This is a separate credential. Top Pro Accounting is not a CPA firm; the representation here is provided by an Enrolled Agent.
- Enrolled Agent (EA)
An Enrolled Agent is the highest credential the IRS awards, and the only one earned by passing the IRS's own examination on tax, representation, and ethics. An Enrolled Agent is licensed federally, by the U.S. Department of the Treasury through the IRS, and holds the same unlimited rights to represent any taxpayer, on any tax matter, before any IRS office.

You sign Form 2848, the IRS Power of Attorney and Declaration of Representative. It authorizes us to speak with the IRS for you, receive your notices, and act on your behalf.

With that authority, we obtain your IRS account, wage, and income transcripts. They show exactly what the IRS sees: what was filed, what is missing, what is owed, and where the account stands.

We File Any Missing Returns
Most cases start with unfiled years. We prepare and file the returns that are due, accurately, so your account is compliant and your real balance is finally known instead of estimated by the IRS.

We Put a Defensible Resolution to the IRS
We match your facts to the right option, then prepare and present it: the paperwork, the financials, and the reasoning the IRS needs to approve something reasonable.

We Stay on the Account Through Resolution
We do not hand you a form and disappear. We follow the case, respond to the IRS, and stay on your account until the matter is fully resolved.

Which path fits depends on your numbers, not on a sales pitch. Here are the resolutions the IRS actually offers, and the honest version of how each one works.
- Installment Agreement
When you owe more than you can pay at once, an installment agreement lets you pay the balance over time in monthly payments. It is the most common resolution, and for many taxpayers it is the fastest way to stop collection pressure and get back in good standing.
We size the plan to what you can actually afford, and handle the request and the terms with the IRS.
- Offer in Compromise
An Offer in Compromise lets you settle your tax debt for less than the full amount you owe. It is a real program, and it can change a life, but only if you qualify.
Here is the honest caveat: the IRS accepts an offer only when it reflects your reasonable collection potential, meaning the most the IRS could expect to collect from your income and assets within a reasonable time. Acceptance is never guaranteed, and the program is not for everyone. We tell you candidly whether an offer is realistic before you spend time or money pursuing one.
- Currently Not Collectible
If paying anything now would leave you unable to cover basic living expenses, the IRS can place your account in Currently Not Collectible status and pause active collection. It does not erase the debt, and interest and penalties keep adding up, but it buys you room to recover.
The IRS reviews the account over time, so we plan for what comes after the pause, not just the pause itself.
- Penalty Abatement and First-Time Abatement
Penalties can make a balance much larger than the tax itself. If you have a clean recent compliance history, First-Time Abatement can remove certain penalties, and in other cases penalties can be reduced for reasonable cause.
We identify every penalty that can be challenged and make the request with the support the IRS expects.
